The NSW Government has released draft regulations to support the strata reform bills passed by the NSW Parliament on 27 October 2015.
The Strata Schemes Management Regulation 2016 and the Strata Schemes Development Regulation 2016 support the new Strata Schemes Management Act 2015 and the Strata Schemes Development Act 2015 which are due to come into effect later this year.
Some of the detail contained in the regulations includes:
- provisions to accommodate modern technology for virtual meetings and electronic voting
- reducing the voting requirement from a special to an ordinary resolution for owners to install sustainability infrastructure such as solar panels, solar hot water and ceiling insulation
- the documentation and procedures for the collective sale and renewal reform that enables a minimum of 75% of owners in a scheme to jointly agree to sell or redevelop their scheme; and
- draft model by-laws on issues such as pet ownership and smoke penetration.
A Regulation Impact Statement outlining the objectives and detail of each proposed regulation is also available.
Members of the public and stakeholders are encouraged to suggest any improvements needed to the draft regulations to ensure they work as effectively as possible.
